The COVID-19 Law Lab is designed to ensure that all laws related to the pandemic protect the health and well-being of individuals and communities and comply with international human rights standards. As transmission rates in the Community decrease, COVID-19 vaccines become more available and new guidelines are introduced for the general population, prisons and detention centres may consider when to change COVID-19 prevention measures at facility level. These measures may include quarantine records, symptom screening, mask policies, distancing measures, restrictions on visiting or outdoor placement, restrictions on recreational programs, and other procedures described above. To develop a long-term COVID-19 prevention plan, institutions may need to weigh the logistical and psychological challenges associated with intensive mitigation measures against the risks of transmission of SARS-CoV-2 (the virus that causes COVID-19). To allow for reflection on this decision-making, this section contains: The majority of the following guidelines are designed to apply to any correctional facility or detention centre, whether in writing or with changes based on the structure and individual resources of an institution. However, issues related to the assessment of health and clinical care for individuals with or suspected of COVID-19 infection and their close contacts may not apply directly to facilities where local health services are limited or non-existent. For these types of facilities, it will be particularly important to coordinate closely with their state, local, tribal and/or territorial health services when identifying detainees/detainees or staff with confirmed or suspected COVID-19 to ensure effective medical isolation and quarantine, necessary medical examination and care, and medical transfer as required. The guide defines strategies adapted to non-on-site health facilities where possible. Check the Light icon Employees identified as close contacts of someone with COVID-19 must be tested for SARS-CoV-2 and quarantine at home for 14 days, unless a shortage of critical personnel prevents asymptomatic people from being quarantined (see Critical Infrastructure Personnel Considerations). These guidelines will not necessarily address all possible custody parameters and cannot use legal terminology specific to the authorities or processes of individual bodies. Check the light symbol Provide cloth face masks (unless otherwise stated) and perform symptom screening and pre-intake temperature checks for all newcomers to identify people with symptoms and place them in immediate medical isolation. Screening must take place immediately after entry into an outdoor space, in Port Sally, or immediately after entry into the facility prior to the commencement of the registration process at the port of entry. See the Screening section below for the formulation of screening questions and a recommended procedure for safely performing a temperature test. Employees performing temperature checks must wear the recommended PPE (see PSA section below).

Check the light icon Ensure that employees and inmates/inmates are trained to remove PPE after leaving a room where PPE is needed as needed as part of their duties and work details. Ideally, employees should put on clean PPE before entering another area of the facility that also requires PPE. If a person suspected of having COVID-19 is in the facility (among inmates, staff or visitors who have recently been indoors), start implementing management strategies while test results are pending. Key management strategies include placing suspected or confirmed COVID-19 individuals in medical isolation, quarantining their close contacts, and facilitating necessary medical care while adhering to relevant infection control and environmental disinfection protocols and wearing the recommended PPE. Verification light icon Note that when interrupting group activities, it is important to identify other forms of activity to support the mental health of detainees/inmates. Mark the light icon The recommended PPE for inmates and correctional staff depends on the type of contact they have with a person with COVID-19 and their close contacts (see Table 1). Each recommended type of PPE is defined below.

As mentioned above, it should be noted that during the COVID-19 response, PSA shortages are expected in each category. Check the light icon Employees interacting with inmates with symptoms of COVID-19 must wear the recommended PPE (see Table 1). Check the light icon Basic prevention measures that still remain in place Throughout the ECQ, IDLO also worked with partners AMLC and DOJ to complete the development of training modules already underway. These include modules on fighting fraud and corruption with AMLC, as well as on environmental law and human trafficking with the DOJ. Check the light icon Detainees with symptoms of covid-19 must wear a mask (if they are not already wearing one and unless contraindicated) and be immediately placed in medical isolation. See the Medical Isolation section below. Check Lighting icon Do not add more people to an existing quarantine cohort after the start of the 14-day quarantine period. This would complicate the calculation of the quarantine time of the cohort and could introduce new sources of infection. Mark the light icon Some institutions may choose to quarantine all new intakes for 14 days before they are usually transferred to the general population of the facility (not because they have been exposed to someone with COVID-19).

In this scenario, do not mix people in routine admission quarantine with people who are quarantined due to exposure to COVID-19. Close contact of a person with COVID-19 – Someone who has been within 6 feet of an infected person for a total of 15 minutes or more over a 24-hour period*, starting with 2 days before the onset of the disease (or, in the case of asymptomatic patients, 2 days before taking test samples) until the patient is isolated.
