Availability is paid and stopped. An authorized agent may begin or stop availability payment by submitting a standard Form (SF)-52, „Personal Action Request” for processing. If a certification is issued late or expires due to an administrative error, the situation can be corrected retroactively. Partial payments can also be approved and paid. A criminal officer is entitled to compensation for the exemption if he or she performs a supervisory or administrative function that has been officially recognized as a „secondary activity” under the LEO age regulations, even if the criminal investigator is not personally identified by the criminal investigator. LEAP ensures that agents are available and pays for the extra work they will be doing. The law sets the availability salary at 25% of the officer`s basic salary. Uniformed law enforcement officers, such as FBI police and uniformed intelligence officers, are not eligible for LEAP because they have a different job classification. The Branch may suspend or deny certification if a criminal investigator fails to perform assigned duties that the investigator claims to be working or that the investigator is unable to perform for a period of time for health reasons. In the event of cancellation or refusal of certification, the auditor`s right to standby pay shall be suspended for a reasonable period of time.
If a criminal investigator appeals the suspension or revocation of certification, the original certificate is included in the appeal record (5 CFR 550.184(d)). For the federal government, the availability of law enforcement can actually save money. The long hours that agents often have to work to complete a case can result in massive overtime payments. However, officers who receive LEAP are not eligible for other forms of overtime pay. Availability hours are hours outside the auditor`s 40-hour week during which an auditor is placed in a state of availability by being asked to be available for specified periods of time to meet the agency`s requirements. Setting the reviewer`s availability status does not count as the reviewer`s overtime schedule. On-call hours may also include hours during which an investigator is available to meet agency needs (Title 5, Code of Federal Regulations (CFR) 550.182(d)). Criminal investigators who receive standby pay are not covered by the overtime pay provisions of the Fair Labour Standards Act. Only criminal investigators with the appropriate occupational classification are eligible. They must be classified in the GS-1811 (Criminal Investigations) series of the federal public service system or GS-1812 (Gaming Law Enforcement). At management`s discretion, standby pay may be paid during initial training during the first year of service and for periods of excused absence with pay (for example, during an evacuation or extended facility closure), except that payment is mandatory for moving during a period of excused absence (5 CFR 550.185). Eligibility for available money is limited to criminal investigators correctly classified in the GS-1811 (criminal investigations) and GS-1812 (hunting law enforcement) series according to Office of Personnel Management standards, pilots employed by the U.S. Customs Service, and special agents of the Diplomatic Security Service. The receipt of available money does not affect a criminal investigator`s entitlement to other types of bonus payments (including overtime pay under Title 5) based on normal hours of service. However, a criminal investigator who receives available money cannot receive any other premium remuneration based on unplanned hours of service. Federal employees receive money from law enforcement in recognition of their work schedule, which requires 50 hours a week or more, sometimes at irregular hours. Special constables can also be on call 24 hours a day. According to the law, the disposable salary is set at 25% of the basic salary of a criminal investigator. However, the biweekly maximum income restriction for LEOs at 5 U.S.C. 5547(c) applies. For workers receiving standby pay, overtime pay under Title 5 is only allowed for overtime hours scheduled before the administrative work week and exceeding 10 hours on a day that includes part of the basic 40-hour work week or a day that does not include part of the basic 40-hour work week.

5545(c)(2) received by law enforcement officers, on-call compensation pursuant to 5 U.S.C. 5545(c)(1), the direct portion of firefighter compensation received by firefighters under 5 U.S.C. 5545b, and physician comparability allowances under 5 U.S.C. 5948. However, such payments are considered basic salary for special purposes only if the law or regulation expressly so provides. There is no legal basis for automatically treating these payments as base salary under the Reservist Differential Authority at 5 U.S.C. 5538. These payments are not synonymous with local allowance or special rate supplements, which are additional compensation for hours of an employee`s base work week that are treated as base salary for bonuses and benefits.
I understand that as a condition of receiving standby pay in accordance with 5 U.S.C. § 5545a, I must have an average of at least 2 hours of unscheduled service per normal business day over the next 12 months. I understand that failure to perform an average of at least 2 hours of unscheduled service per normal business day could result in an overpayment, and that hours of work that are incorrectly reported or not performed on time may result in adverse action and recertification of standby payments. Law enforcement availability is the additional remuneration that the government pays to federal law enforcement officers who are criminal investigators or special constables. This remuneration is in addition to the base salary and represents a significant contribution to an agent`s income. Any criminal investigator whose annual average of non-scheduled service is certified (or, as expected, certified) of 2 hours or more per regular business day is deemed to have completed the significant hours of non-hourly service required to be eligible for standby pay. This average is calculated by dividing the total number of unscheduled hours of service for the annual period (numerator) by the number of regular business days (denominator) (5 CFR 550.183(a)). An involuntary suspension of availability payment due to a denial or cancellation of certification is considered a reduction in compensation pursuant to 5 U.S.C. § 7512 and will be conducted in a proceeding against adverse action. An auditor whose certification is rescinded with involuntary suspension of standby pay may appeal the measure after a negotiated or regulatory appeal against adverse action (5 CFR 550.184(e)).
Initial certification. On the date of appointment or after completion of formally approved initial training, the Auditor and a delegated administrative officer shall provide the Head of the Agency with an initial certificate attesting that the Auditor is expected to meet the essential hours requirements within the next 12 months.
