That means that when an Apple executive described the settlement as a victory for developers, reporters were already rushing to tweet and submit early drafts of articles. The tech giant was fined 1.1 billion euros ($1.2 billion) in 2020 by France`s competition authority for antitrust violations related to restrictions in contracts with wholesalers, which it has appealed. In addition, the European startup association France Digitale has also been highly critical of Apple`s practices, working on its own legal steps. There has been cautious praise from some lawmakers who have proposed legislation to change App Store rules. Senator Richard Blumenthal, a Democrat from Connecticut, said on Twitter that the agreement „represents a significant step forward, but does not correct the full and dynamic range of market abuse and practices that still prevail in app markets.” Apple has denied all allegations and the settlement is not an admission of wrongdoing on the part of the company. Developers who receive a settlement can no longer sue Apple individually for the same claims filed in the class action lawsuit, including alleging that they were overcharged by Apple due to the App Store`s pricing structure. „If the developer community had had any hope for this class action lawsuit, this outcome would have been a dagger in the heart.

As a result, headlines initially portrayed the change as an important way for companies to avoid Apple`s commission. This was good for Apple, as any perception that it is making significant changes to its App Store rules could help appease developers, courts, regulators and lawmakers. An app developer`s lawsuit over App Store rejections, fraud and fraud ended in a settlement agreement after court records showed a motion to dismiss the lawsuit earlier this summer. The plaintiff, app developer and former Pinterest engineer Kosta Eleftheriou, has made a name for himself in recent months by exposing some of the App Store`s most egregious scams. This then culminated in his own lawsuit against Apple, filed in California Superior Court in Santa Clara County in March 2021, claiming that his own app had been wrongly rejected from the App Store and later targeted by fraudsters, resulting in lost revenue. Apple already provides more than 30 million registered developers with all the tools, resources, and support they need to build and deploy software on Apple platforms to more than one billion customers worldwide. The complaint alleges that these commissions, in addition to Apple`s $99 annual development program fee, hurt developer revenue and stifle innovation — and yet, developers are not allowed to offer alternative payment methods under Apple`s App Store rules, or distribute their apps to iOS users outside of the App Store. although Apple allows them to do so on Mac computers. According to court documents, about 67,000 developers were eligible to file a claim. It is not known how many claims have been filed. After a productive dialogue, Apple and the plaintiffs in the lawsuit of developers Cameron et al. v. Apple Inc. an agreement outlining seven key priorities shared by Apple and smaller developers, which has been submitted to the judge in charge of the case for approval. Payments are divided into income classes and, as we understand it, the minimum payment applies to the entire income class and is not prorated based on exact earnings. For example, if you won $900,000, the minimum payout is $20,000, not a prorated amount closer to $30,000.
Many companies that pay Apple`s commission haven`t been so kind. The Coalition for App Fairness, a group of companies fighting Apple`s rules, said the deal „does nothing to address the structural and fundamental issues faced by all developers, large and small, that undermine innovation and competition in the app ecosystem.” The group added that Apple`s restrictions on what companies could say in private communications with their customers illustrated Apple`s inappropriate control over the app market. As part of the settlement, Apple also updated its App Store review guidelines to allow developers to use external communications, such as email, to share information about payment methods available outside of iOS apps.
