To be eligible for a portion of the settlement, a developer must have earned money on the App Store between June 4, 2015 and April 26, 2021, but no more than $1 million in a calendar year. Based on App Store Small Business program rules, we assume that this amount is net after Apple`s commission and not gross App Store revenue. To participate in the program, news organizations must provide their customers with access to their Apple News content using the Apple News format. Participating organizations receive a 15% commission on eligible subscriptions to their messaging app. In conjunction with the App Store Small Business Program, this new program will help news organizations offer multiple ways to make their content available to Apple customers while supporting local journalism. For more information about the program, see apple.com/newsroom. That means that when an Apple executive described the settlement as a victory for developers, reporters were already rushing to tweet and submit early drafts of articles. The incentives in today`s digital news reward those who are first, not those who are more nuanced or precise. (An Apple public relations official urged reporters not to name or quote the executive to hear the briefing.) The developer says he`s now working on a project related to an iPhone keyboard, but doesn`t have any more details to share at this point. Notably, his amended complaint was about difficulties in creating keyboard apps, as Apple never provided a developer API to request „full control” directly from the keyboard. It also argued that Apple limits third-party keyboards in areas such as available memory, the ability to collect data to make better predictions, the ability to be used in password fields, and restrictions on displaying visual elements above keyboards, the complaint says. And he agreed to create a $100 million fund for small app developers. (More on that later.) Eligible developers were expected to receive a payment of between $250 and $30,000 from Apple, based on their total App Store revenue, but actual payouts are higher because not all developers have filed a claim, increasing each developer`s share of the settlement.

Only developers in the United States who generated revenue from the App Store between June 4, 2015 and April 26, 2021 and filed a claim before May 20, 2022 will receive a payment. Calculating how much you`ve earned on the App Store can be tricky. Tools like RevenueCat have to make certain assumptions about pricing, commission rates (30% vs. 15% for renewals after 1 year), currency conversions, taxes, and other factors – our reports are close enough to make business decisions, but not accurate enough for accounting. It`s best to use the Revenue report in App Store Connect. Funnily, you can`t choose the exact billing date range, because App Store Connect doesn`t allow you to display a multi-year duration per day, so it automatically adjusts to select the nearest start/end week. Today, Apple announced new updates to the App Store with the launch of the News Partner Program. Recognizing the importance of rigorous journalism and a free and independent press, the program includes a new set of initiatives to expand Apple`s support for journalism. Steve Berman, managing partner of Hagens Berman, has a history of beating tech giants after reaching a $560 million settlement against Apple over e-book pricing and a $90 million settlement on behalf of Android developers.

He is working with Paris-based antitrust lawyer Fayrouze Masmi-Dazi on the proposed class action lawsuit. If the developers win, it wouldn`t be the first antitrust case against Apple in France. The tech giant was fined 1.1 billion euros ($1.2 billion) in 2020 by France`s competition authority for antitrust violations related to restrictions in contracts with wholesalers, which it has appealed. In addition, the European startup association France Digitale has also been highly critical of Apple`s practices, working on its own legal steps. There has been cautious praise from some lawmakers who have proposed legislation to change App Store rules. Senator Richard Blumenthal, a Democrat from Connecticut, said on Twitter that the agreement „represents a significant step forward, but does not correct the full and dynamic range of market abuse and practices that still prevail in app markets.” Apple has denied all allegations and the settlement is not an admission of wrongdoing on the part of the company. Developers who receive a settlement can no longer sue Apple individually for the same claims filed in the class action lawsuit, including alleging that they were overcharged by Apple due to the App Store`s pricing structure. „If the developer community had had any hope for this class action lawsuit, this outcome would have been a dagger in the heart.

Much worse than if no complaint had been taken,” he wrote. „On the contrary, this agreement cements the enormous power that Apple possesses and wields. Even if a class action lawsuit begins, it can be bought with bromides and bribes. The case is now one of several antitrust litigation Apple is facing, including the high-profile lawsuit with Fortnite maker Epic Games that is under appeal, and another from alternative app store Cydia. As a result, headlines initially portrayed the change as an important way for companies to avoid Apple`s commission. This was good for Apple, as any perception that it is making significant changes to its App Store rules could help appease developers, courts, regulators and lawmakers. An app developer`s lawsuit over App Store rejections, fraud and fraud ended in a settlement agreement after court records showed a motion to dismiss the lawsuit earlier this summer. The plaintiff, app developer and former Pinterest engineer Kosta Eleftheriou, has made a name for himself in recent months by exposing some of the App Store`s most egregious scams. This then culminated in his own lawsuit against Apple, filed in California Superior Court in Santa Clara County in March 2021, claiming that his own app had been wrongly rejected from the App Store and later targeted by fraudsters, resulting in lost revenue. The lawsuit aims to force Apple to allow competition in the distribution of iOS apps and remove price caps that prevent developers from setting their own prices for in-app purchases. He also wants Apple to compensate developers for „excessive fees” and prevent Apple from increasing the current 15% commission for developers in its small business program for at least three years. With the updates announced today, the App Store is evolving into an even better business opportunity for developers while maintaining a secure and reliable marketplace for users.

Apple already provides more than 30 million registered developers with all the tools, resources, and support they need to build and deploy software on Apple platforms to more than one billion customers worldwide. The complaint alleges that these commissions, in addition to Apple`s $99 annual development program fee, hurt developer revenue and stifle innovation — and yet, developers are not allowed to offer alternative payment methods under Apple`s App Store rules, or distribute their apps to iOS users outside of the App Store. although Apple allows them to do so on Mac computers. According to court documents, about 67,000 developers were eligible to file a claim. It is not known how many claims have been filed. After a productive dialogue, Apple and the plaintiffs in the lawsuit of developers Cameron et al. v. Apple Inc. an agreement outlining seven key priorities shared by Apple and smaller developers, which has been submitted to the judge in charge of the case for approval. Payments are divided into income classes and, as we understand it, the minimum payment applies to the entire income class and is not prorated based on exact earnings. For example, if you won $900,000, the minimum payout is $20,000, not a prorated amount closer to $30,000.

Many companies that pay Apple`s commission haven`t been so kind. The Coalition for App Fairness, a group of companies fighting Apple`s rules, said the deal „does nothing to address the structural and fundamental issues faced by all developers, large and small, that undermine innovation and competition in the app ecosystem.” The group added that Apple`s restrictions on what companies could say in private communications with their customers illustrated Apple`s inappropriate control over the app market. As part of the settlement, Apple also updated its App Store review guidelines to allow developers to use external communications, such as email, to share information about payment methods available outside of iOS apps.
